Television Quiz based reality show titled Udan Panam Chapter 4 (“Udan Panam Chapter 4”) is produced by MM TV Limited having its Registered Office at Door No.XII/1359, K. V. M. M. Building, K. K. Road, Kottayam, Kerala – 686 001 and Administrative Office at No.2/275 A, NH Bypass Road, Aroor Post, Alappuzha District, Kerala – 688 534. The rules and regulations for participating in the show are as follows :

I. Definitions :

(a) “Auditions””: Means the ground Audition (held at Cochin city) / video call audition on certain dates as informed by the company or the producer to the selected Contestant(s).

(b) “Auditionee(s)”: The Registrant(s) who is selected for participation in the Auditions.

(c) “Excluded Registrants” : means and includes, employees of the Company or any Group Company, employees of the Producer, employees of the advertising agencies which has been appointed by the Company, employees of the service providers engaged by the company for various activities, employees of the back end IT service provider, employees of the main sponsors and members of their immediate family. Further, all those who are not resident of Kerala, not conversant in MALAYALAM and cannot read either English or MALAYALAM are ineligible to enter the Show. For clarification the Registrant(s) should be conversant in MALAYALAM and should be able to read and understand either English or MALAYALAM.

(d) “Main Sponsors” : Includes Title sponsors, Associate sponsors, Co‐sponsors (Powered-by‐ sponsors) and Telecom sponsors of the Show.

(e) “Immediate family”: Means and includes the respective spouse, children (adult citizens of India i.e. only those who have completed 18 years of age on the date of registration) and parents of the employees, parents of the employees’ spouse and siblings of the employees of the excluded registrants.

(f) “Participant(s)”: The Auditionee(s) who is selected to participate in the Show.

(g) "Programme": The recordings of the Competition in the Studio and / or Contestants Native place or locality (including any seasonal special/s recording).

(h) “Randomizer”: It is a software that generates random bits of information decided by predetermined parameters.

(i) “Registrant(s)": Any person(s) who participates in the Competition and who (i) is a Indian citizen (possessing a valid address proof for the same) (ii) conversant in Malayalam and English and (iii) enters the Show in accordance with the Rules and Regulations stated below and is not an excluded registrant (c)

(j) “Rules & Regulations”: Means present rules & regulations governing the Show, as amended from time to time.

(k) "Seasonal special(s)": Any episode(s) of the Show (defined below) specially recorded to mark a specific time of the year.

(l) “Schedule”: An episode or a set of episodes to be recorded and/or recording dates as pre‐determined by the Company.

II. PROCEDURE TO PARTICIPATE IN THE COMPETITION

A. PERIOD

B. ENTRY MECHANISM

There will be multiple modes (i.e. IVR, SMS, QR Code, manoramaMAX, etc.) through which a participant may register in the call for entry. Each mode for registration will run at different time schedules and the details of the same will be telecast on Mazhavil Manorama television channel; published in Malayala Manorama daily and also on social media pages of manoramaMAX and Mazhavil Manorama. In addition to the above, there will be casting based on creative requirments.

Upon participating in the activity it is deemed that the person sending in the entry has provided MMTV and its Service Providers with permission to send SMSs to or call him / her, whether or not such sender is registered on the National Do Not Call registry.

(l) IVR: The telephone number to which the participant needs to make the call will be telecast on Mazhavil Manorama television channel and / or published in Malayala Manorama daily, social media pages of manoramaMAX and Mazhavil Manorama. Any person interested to participate in the audition can make a call to the said number during the period mentioned in the advertisement. Through IVR the participant should provide certain basic details like name, age, gender, place of residence, etc.

Based on your telecom service provider, the call charges will be applicable. Roaming rates may apply and the registrant should contact the telecom service provider for the applicable rates.

(2) SMS : The telephone number to which the participant needs to send the SMS will be telecast on Mazhavil Manorama television channel and / or published in Malayala Manorama daily, social media pages of manoramaMAX and Mazhavil Manorama. The Participant register his/her number to participate in the audition via SMS by texting :

On receiving the SMS in the prescribed format, contestant is sent a text message Thank you, your response has been registered. For rules and regulations visit www.manoramamax.com/up”.In case of error in SMS format, the response message will be sent “Invalid entry. Please re‐submit your entry in the prescribed format”.

The charges for SMS to 56767123 is Rs.3/- across all operators in India

SMS QUESTIONS- The SMS Questions will be taken from Manorama Year Book.

(3) QR Code : A QR code for the activity will be telecast on Mazhavil Manorama television channel and / or published in Malayala Manorama daily, social media pages of manoramaMAX and Mazhavil Manorama. Any person interested to participate in the audition can scan the QR Code and during the period mentioned in the advertisement. Upon scanning the QR Code, the registrant will reach a online registration page. The registrant need to fill in certain basic details like name, age, gender, place of residence, etc and submit the same.

(4) Registration through manoramaMAX : Any person interested to participate in the audition can fill in the call for entry registration form available on manoramaMAX website during the activity period. The registrant need to fill certain basic details like name, age, gender, place of residence, etc and submit the same.

Upon registration of your name, you may receive a call from MMTV office asking certain details about yourself. There will be multiple levels of auditions. As a level one audition, there will be a videos audition post an audition over the phone. In case the participant is selected, they will have to undergo various sets of auditions in our studio situated at Aroor/ locations specified by MMTV. The video uploaded by you may be used for the promotion of the call for entry activity on social media and TV at the sole discretion of MMTV. The participant/s grant MMTV the exclusive license to use the video to the exclusion of all others and the participant/s shall not claim any consideration from such use

2. REGISTRATION THROUGH MANORAMAMAX.COM & APP

STEP 1

Contestant has to download manoramamax app from google play store or apple app store. The Contestant has to login. The rules and regulation of the show is available in the menu option. The contestant needs to click on the banner Udan Panam Chapter 4 which is available on the home page. The banner will lead to the Udan Panam Chapter 4 page wherein the Contestant need to answer the multiple choice question and fill the fields provided therein :

a) Name: (mandatory field)

b) Mobile Number: (mandatory field)

c) Age: (mandatory field)

d) Gender: (mandatory field)

e) Pin code: (mandatory fill in field)

f) Address: (mandatory field)

Before submitting the entry, the contestant will have to read and accept the terms and conditions of Udan Panam Chapter 4 and key in the captcha mentioned therein. Upon submission of the answer the contestant will be taken to a confirmation page.

3. OTHER MATTERS

a) For AGE, registrant has to enter completed years as on date of registration (for e.g. if a person is 20 years and 11 months old, they will have to enter 20). For GENDER the registrant has to enter M for MALE and F for FEMALE for registration through SMS.

b) For PINCODE, registrant has to enter the PIN CODE for which he/ she has to furnish supporting documents as and when called for by the Company;

c) Registrant are advised to refrain from sending multiple entries for the particular question. It is made clear that we will consider only the first entry provided by the registrant based on the time stamping for the random selection process. It is to be noted that multiple entries do not guarantee selection and no weightage is given to number SMSs sent /online entries made at the time of shortlisting.

d) Telephony, i.e., via mobile (i.e., SMS) or internet are the only methods by which a Contestant can enter the Competition. Nevertheless, the Company reserves the right to introduce any other method/scheme/contest by which Contestants may enter the Competition.

e) The SMS/online registration (together referred to as “Entry”) for participating should have been completed on or before closing of the defined timelines in order to be considered as a valid entry (“Valid Entry”).

III. PROCESS OF SELECTION AFTER REGISTRATION TO PARTICIPATE IN THE COMPETITION

A. LEVEL 1

SELECTION OF CONTESTANTS

1. The correct valid entries will be shortlisted by the randomizer on a daily basis from the valid entries received for each day.

2. The shortlist of valid entries in GENERAL ROUND PERIOD by the randomizer will use the pre‐defined reservation criteria on a reasonable endeavours basis.

3. In the event the Company is unable to meet the “RESERVATION/ QUOTA GRID” from the Contestants who had qualified as per the requirements stated above, the Company reserves the right to put the RESERVATION/ QUOTA processes in abeyance and do as they deem fit or initiate another round of selection process.

B. CALL BACK

1. Timelines for the call back is left to the discretion of the Company and all decisions will be based on on‐ground conditions, degree of participation, technical issues and force majeure reasons.

2. Further, the selected Registrants will receive calls from the Company Executives (“CE”) and the selected Registrants must confirm the details required by the CE immediately. The CE will ask the Registrant to confirm if he/she has sent the entry for participation in the Show. If the required details are not provided immediately or if they are not able to procure confirmation of the Registrant, then the CE will call once again from the initial telephone contact, asking for the same details and failure to provide such details shall lead to disqualification of such Registrant from the selection process.

3. Further Company is not responsible if the call‐back is not successful due to including but not limited to the following reasons:

a) Line being busy/dead/ out of service

b) Congestion on the network

c) No answer received

d) Number does not exist

e) Number has been disconnected

f) Out of coverage area

g) Switched off

h) Poor call conditions / unclear reception

i) Number engaged

j) Call drop

k) Other reasons that could render a call unsuccessful or terminate it.

4. Company and/or its authorized agents, affiliates and representatives will use their reasonable efforts to contact the selected Registrants, but will not be responsible or liable in any way whatsoever if the Registrants cannot be reached by telephone.

5. Further, the Company shall not be liable in the event the Registrant is not able to participate in the following rounds of selection due to any delay or non receipt of such call back to the Registrant.

6. The following process will be followed by the CE once connected with the selected Registrants:

a) If the receiver of the call confirms immediately to the CE that he/she is the Registrant, then the CE will ask the registrant to confirm his/her availability on the /audition dates and the shoot dates. In the event the Registrant is available on the dates mentioned, the CE will capture the name, address and other details required to continue with the registration.

b) In the event the Registrant is not available on those dates, the Registrant will not be permitted to continue with the registration process and shall be considered as disqualified from further participation in the Show.

8. The CE will thereafter ask the Registrants to verify the details like his/her full name, age, gender and Pin code.

C. There will be special/ celebrity episodes for which shortlisting of contestants will be performed through an alternate process of registration/casting by Production House/Channel

C. AUDITION

STAGE 1

1. The Audition (ground or video audition) will be conducted as intimated by the Producer. (“First Audition Period”). The timings of Auditionees will be intimated, and cannot be changed or modified to suit Auditionees’ requirements.

2. The Auditionees will have to be present at the allotted date and time given to such respective Auditionees.

3. All Auditionees shall abide by the Rules & Regulations thereof. Further the instructions of the Company /Producers shall be adhered to strictly.

4. Any Auditionee who acts in contravention to the instructions of the Company or the Producers or creates nuisance either to the Company or to any other person, shall immediately be disqualified from participating in the Audition and the Show.

5. The decision of the Company/Producers in connection with the Audition including but not limited to shortlisting the Auditionees will be final & binding and is non‐contestable. In case of any dispute or difference in respect of this Audition, the decision of the Company shall be final and binding on all concerned.

6. More over there will be special/ celebrity episodes for which shortlisting of contestants will be performed through an alternate process of registration/casting by Production House/Channel.

7. Based on Company’s requirement and creative discretion, the final selection of contestants for any Episode of the Show will be made from amongst the shortlisted pool of Auditionees or from the list of Contestants from assigned production House.

D. SHOOT

1. We will be shooting the show complying by the government guidelines passed from time to time in respect of COVID 19. For the safety and security of the participants, community and our crew(s) the said guidelines will be followed in letter and spirit.

2. The representatives of the Producer (“Representatives”) will notify the selected Auditionees of their selection. After which the Representatives will inform the selected Auditionees of the shoot date and documentation requirements, based on finalized shooting schedules.

3. The Participant is requested to carry a valid English/Malayalam Identity proof for the shoot. Based on convenience of the Producer the shoot may happen at MMTV studio or Contestants house or native place or locality or such other place as may be decided by the Producer following the government guidelines. In case of non‐availability of Participant or of his/her supporting documentation, further participation will not be permitted.

4. The Participant shall ensure that provide the Company representative with attested photocopies of either (i) valid passport/driving license or (ii) PAN Card along with birth certificate and ration card or (iii) voter identity card with birth certificate. These documents have to be in English or Malayalam language. Original of the same shall be produced as and when demanded by the Company.

5. On the shoot date intimated by the Producer Contestants will be met at the shoot location by a representative of the Company. Contestants will be required to sign in form specifying (i) their confirmation that they have understood and agreed to the rules of the Show and (ii) their consent to the recording of their contribution to the Show in question, and thereafter to the broadcast and all other audio visual exploitation of the same and to the publication of his/her name and photograph in any media.

IV. General Rules

1. A citizen of India having valid government issued identity proof (holding valid passport in case of NRI) can only participate in this reality show. Person(s) are entering the Show on their own behalf and entry(ies) by proxy will not be accepted, even for their family members. An entry/ies is not transferable. Registration to the Show does not guarantee the selection of the Registrant(s) to proceed with the Show Registration also does not entitle any Contestant(s) to a prize or award.

2. The Participant (“Participant”) confirms that he / she had read the rules and regulation of this show uploaded in https://www.manoramamax.com/UP4-RandR and understood the format, production procedure of the program.

3. The Participant acknowledge that he/she has voluntarily chosen to participate in the Program at his/her own wish and free-will and is willing to bear all risk, costs and consequences (if any) arising from such participation in the Program to be produced by MMTV. Participant is aware that for participating in the show, no remuneration will be paid by MMTV to The Participant.

4. The Participant confirms that he/she is not administering any medicine, do not suffer from allergy, illness and / or ailment, any type of bodily injury which would be detrimental for his/her participation in the Program. The Participant further confirms that he/she is physically, psychologically and mentally fit to participate in the Program. Before the shoot the Participant undertake to give declaration (i) that neither he / she or any of their family members were under observation for Covid 19; (ii) that their place of stay / work place is not within the hotspot / containment zone; (iii) that to their best of their knowledge they didn’t interact with persons under observation for covid 19 as part of their professional engagement, (iv) that they duly vaccinated.

5. We will be shooting the show complying by the government guidelines passed from time to time in respect of COVID 19. For the safety and security of the Contestant, community and our crew(s) the said guidelines will be followed in letter and spirit. Please note in case after the shoot schedule and Contestant is finalized and the Contestant place of residence and / or shoot location is classified as hot spot / containment zone then the said shoot/Contestant will be cancelled for the season.

6. The Participant agrees to act responsibly, with utmost integrity and shall maintain a high standard of behaviour, attitude and appearance, at all times during the shooting schedule. The Participant shall not abuse or misbehave with any other Co-Participants (if applicable) or the staff of the Producer. The Participant shall not share / express any thoughts / views / comments against the judgement or content of the program through any social media or to any other persons orally or in writing.

7. The Participant shall not share / express any thoughts / views / comments against the judgment or content of the program to any person orally or in writing nor shall they provide any comments through any social media unless specified/approved by the Producer.

8. There will be 15 questions worth Rs.1,00,000/- (Rupees One Lakh Only) each. All questions are compulsory. The Participants/team will be given Rs.10,00,000/- (Rupees Ten Lakh Only) credit and combined the Participants/team stands to win Rs.25,00,000/- (Rupees Twenty Five Lakh Only). If the Participants/team goes wrong for any question, the fall in money will be half of what he/she/they have won till then. To aid the Participants/team through the questions each Participants/team can avail one lifeline once for the entire duration of the game. Life line on multiplayer mode can be availed when both players pass for the same question. The Producer reserves the right to change the structure of the Show as it deems fit including without limitation by adding/reducing / altering rounds to the Show.

9. The maximum prize which can be won by any Contestant(s) in the show upon providing correct answer to all the question posed and correctly completing all the task is Rs.25,00,000/- (Rupees Twenty Five Lakhs only).

10. Upon wining the prize, at the time of shooting, a symbolic transfer of prize amount only will be done. The prize amount will be paid only after 90 bank working days of telecast of the episode in which the Participant had participated. Any and all taxes and/or levies applicable on the prize money won by the Participant(s), under the laws of India shall be borne by the Participant(s) in relation to the prize. Payment of prize money to the Winner(s) shall be after deduction of all applicable taxes and levies and subject to providing the relevant documents as intimated by the Company and will be paid within the time stipulated by the Company. While releasing prize amount, MMTV shall deduct the tax at source (if applicable) and issue TDS certificate in the name of the Participant. To facilitate payment of prize, the Participant should share full name and address, duly attested copy of any government issued ID, PAN, etc.

11. In case the participant is a minor, then the winning prize after tax deductions is above 50,000/- the will be equally divided and paid as follows between the minor participants/team member :

(a) 50% of the prize money will be deposited in a bank as fixed deposit which will mature on attaining of 18 years by the winner.

(b) Balance 50% will be paid to the parent of the winner through cheque or direct transfer to the bank account of the parent of the winner

12. The Participant can be eliminated if he/she is found indulging in unfair methods to answer the question. MMTV reserves the rights to debar the Participant from participating in the show, if Producer/Anchor is convinced that he/she/their parents/friends have indulged in any activities which has affected the image or tarnish the reputation of the channel or if the terms and condition is violated. The Participant can also be eliminated it they are found not fit for the show / programme and / or without assigning any reasons. None of the Participant(s)/Contestant(s) shall, without the prior written approval of the Company, speak to the press or any other media or any third person, nor give any interviews or comments relating to the Auditions or any aspect of the Show/Program or write blogs, post any messages in social networking or any site including but not limited to Facebook, Twitter, Whatsapp, etc. The Participant(s)/Contestant(s) shall not disclose any information whatsoever relating to the Company/Producer to any other party. Violation of this clause shall immediately disqualify the Contestant’s prospects of further participation. The Participant(s)/Contestant(s) shall at all times keep confidential the selection process and all details regarding the Show including Audition which he/she might be informed of or which he/she might learn or come to know of as a Contestant(s) or as a short listed potential candidate. After the shoot if the Participant has violated or committed any breach of the rules and regulations or indulged in any activity which has tarnished his / her image, Company has every right to withhold telecast of the particular episode and forfeit the amount won by the Participant. Decision of the Producer of the Show is final in this regard.

13. It is understood by the Participant that MMTV being the Producer of the Program, the exclusive right to shoot and telecast the Program in all medium of communication in the entire world including India in perpetuity vest with MMTV. All right, title and interest, including but not limited to the Intellectual Property Rights, in the show and in any and all responses received shall rest solely and exclusively with MMTV at all times.

14. Each Contestant is required to refrain from wearing any clothing items bearing designer or sports logos or bearing the name or likeness of a celebrity, living or dead, during the shoot Part of the show. Further Contestant(s) are not permitted to wear or mention any competing TV channel names, or names of competitors of sponsors of the Show. The Contestant shall adhere to the Clothing instructions that shall be provided to him/her in this regard. The Contestant(s) shall not express any communal / religious / racist or other provocative thoughts on the program.

15. Participant shall further undertake that the Participant will not use / possess any intoxicating article while participating in the show or at the shoot location. If MMTV comes to know that the Participant had possessed or consumed intoxicants and appeared for the show or while in the shoot location then, the MMTV / Producer / Anchor shall be entitled to eliminate and / or expel the Participant from the Programme at its sole discretion. The Contestant(s) must at all times behave appropriately when taking part in the Show and observe these Rules & Regulations and any other Rules & Regulations in force at the Auditions and/or Shoot locations. The Company reserves the right in its absolute discretion to remove from the Show, Audition, Studio any Contestant(s) who breaks such rules and/or fails to behave appropriately and to disqualify such Contestant(s).

16. The Participant shall be solely responsible for any consequences which may arise due to his / her participation in the show. Participant also undertake to indemnify MMTV and their respective officers, directors, employees and agents on the happening of any event (including without limitation cost of attorney, legal charges, etc.) on full indemnity basis for any loss/damage suffered by MMTV on account of act on the part of the Participant.

17. MMTV shall have the absolute right to decide the date and time of telecast. MMTV shall also right at its absolute discretion to withhold any episode shot by them. Decision of MMTV is final in this regard.

18. MMTV reserves the right to change, defer, alter or cancel this show in part or full or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Any decision of MMTV in this regard and in general with respect to this show and the terms and conditions thereto shall be final and binding and that no further communication shall be entertained in this regard.

19. By participating in the show and thereby accepting the Terms and Conditions as mentioned herein, the Participant hereby releases MMTV and / or any of its respective officers / employees from and against all liability, cost, loss or expense arising out of participation in the show including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to any negligent act or omission or otherwise.

20. The Participant undertakes to abide by the said regulations as well as the directions issued by the Producer of the Show from time to time.

21. Company/Producer may, at its discretion contact the Registrant(s) and/or Contestant(s), if required, for any clarifications needed for the information provided in the registration. Participant / Contestant confirms that they have no objection in Company or their authorized representatives calling them in connection with the show any time between 09:00 AM and 09:00 PM Monday through Sunday.

22. Company has the right at any time to require proof of identity and/or eligibility. Failure to provide such proof within a reasonable time could result in disqualification from participating in the Show.

23. In case there is any mismatch of Contestant(s) details in any round of the Show, the Contestant(s) may be disqualified from further participation in the Show, if Contestant is unable to resolve discrepancies.

24. The number of Auditionees to be selected shall be at the sole discretion of the Company / Producer. The Contestant(s) understands that getting shortlisted in the Audition is only a preliminary step towards further participation in the Show and it shall be the absolute and sole discretion of the Company/Producer to allow participation based on creative requirements.

25. Apart from the Registrant(s), the Company may at its sole discretion provide a chance for entry to the Audition/Show for unregistered individuals also, based on programming needs, should they arise, or in the event of participation selection process or system failure through Casting by vendors / Service Providers. Company also has the right to conduct “celebrity special Episodes” or “seasonal special Episodes” where certain persons of prominence may be invited to participate in the Show.

26. The Company hereby reserves the right to prevent any Contestant(s) or any of their representatives to check / audit / challenge the logic of selection of Contestants for the Show.

27. The Company reserves the right to classify the Contestant(s) in such socioeconomic categorizations (SEC) that it deems appropriate.

28. The Company may in its sole discretion exclude a Contestant from participating in the Audition/Studio Part of the Show which may include without limitation (i) circumstances which, in the Company's view, renders the Contestant unfit to participate therein; (ii) inability to produce documentation specified by the Company proving the identity of the Contestant; (iii) any other reason that, at the discretion of Company, would adversely impact the Company, Channel or Show.

29. At no point of time will the Company/Producer be obliged to notify unsuccessful Contestants of its decision.

30. The Company will have no liability to a Contestant who is unable to attend or take part in the Show for whatever reason and the Company shall be entitled to disqualify the Contestant(s), replace any such Contestant(s) from the Show at any time, at the discretion of the Company.

31. On request of the Company, the Contestant(s) shall also make arrangements for the Company to have access to his / her residence, work place, favorite hangouts, pets, etc and obtain necessary permissions from his / her parents, siblings, friends, colleagues to be photographed, interviewed and to record or click their photographs, videos etc..

32. As part of Contestants’ contribution to the Program/Show, the Producer may request Contestant(s) to participate in any online/interactive activity relating to the Program/Show including without limitation recordings of web-casts, interviews and participation in so-called ”chat-rooms”. It is a further condition of entry and participation in the Show that Contestant(s) ensure and procure from any and all Contributors their agreement and execution of the release form as devised from time to time by the Company/Producer.

33. The Winner(s) of the Show agrees that he/she shall make himself/herself available from time to time and co-operate with the Company and participate in any activity and/or campaign (“Promotional Activity”) of any nature whatsoever without any money payable to the Winner(s). Further, the Winner(s)/Contestant(s) shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever if required by the Company. The Winner(s)/Contestant(s) agrees that the footage of any nature shall vest with the Company, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.

34. Any photographs, videos etc submitted to the Company/Producers or recorded by the Producers during the Audition or registration procedure shall on submission / creation become the property of the Company and shall be available to the Company for exploitation throughout the world in perpetuity The Contestant(s) shall ensure that the photos or videos submitted by them in any public domain or their performances shall not be obscene, vulgar, defaming, denigrating women or children, hurting religious sentiments, depicting violence or shall not infringe the rights of a third person In the event of any violation to the aforementioned, the Contestant(s) shall immediately be disqualified from taking part in the Auditions/Show or any further rounds of participation and such Contestant(s) shall solely remain liable for any action (criminal/civil) arising therefrom.

35. Acceptance of these Rules and Regulations by the Participants / Contestants constitutes permission for the Company its affiliates and Producer to click photographs, record videos of the Contestant(s) and use the Contestant(s) name, photographs, likeness, voice and comments for advertising and promotional purposes in any media worldwide for purposes of advertising and trade without any additional compensation whatsoever.

36. The Company or the Producers will not entertain any claims / questions / queries with respect to the authenticity or correctness of any questions and answers for the questions asked in any round of the Show. The Company’s decision on the correctness or incorrectness of any answer is final and binding on all Contestants.

37. In the event of any fault, misunderstanding or dispute concerning any part of the Programme / Show, and/or the operation of the telephone system, Auditions, Callbacks, the selection of Contestant(s) at any stage, or the validity of any question or answer options, the decision of the Company shall be final and binding on all Contestant(s). The Company / Producer of the Show is empowered to take a decision on any case or instances not covered by the present Rules and Regulations.

38. The Company reserves the right to amend (add, delete or modify) the Rules & Regulations governing the Show and/or the Participant selection process prospectively or retrospectively, at its discretion and without prior notice, in order to improve the Show or remedy any issues that occur and any such additions, alterations or modifications to the rules and regulations may/shall be notified as separate amendments or addendums as may be decided by the Company at its sole discretion.

39. The Company has the right at any time to terminate the Progarmme / Show without any prior intimation or notice to the public and also the Company is not obligated in any manner whatsoever to compensate any person or persons who have participated in the Show and/or accommodate any person or persons who have been selected in the Program.

40. If the operation of the Show (including without limitation the operation of the related telephone systems, software systems, etc); the recording; broadcast of any/all of the Show is prevented by an event of force majeure, the Company may cancel all or any part of the Show/Show, or take such other decision as it deems fit.

41. Notwithstanding a Contestant's participation in the Show, there is no obligation on the part of the Company to broadcast any Episode in which he/she has taken part, or any or all of his / her contribution as recorded by the Company.

42. The Company reserves the right to re-schedule the date(s) of registration, callbacks, Auditions, recording the Studio Part of the Show and broadcast, at its discretion.

43. The Company’s decision (or, where appropriate, the decision of the Judges) is final and the Contestant(s) acknowledge that the interests of the Program/Show shall override those of any Contestant(s) and/ or Contributor.

44. If any provision of these Rules & Regulations is held by any court or other competent authority to be void or unenforceable in whole or part, the other provisions of these Rules & Regulations and the remainder of the affected provisions shall continue to be valid.

45. These Rules & Regulations and the Show shall be governed by and construed in accordance with the laws of India and the Contestant(s) submit irrevocably to the jurisdiction of the Courts in Cochin.

46. Use of mobile phones or any smart devices will not be permitted during the shoot, and during the Auditions It may lead to disqualification.

47. The Company / Producer of the Show is empowered to take a decision on any case not covered by the present Rules and Regulations.

48. The Company and/or the Channel is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any physical injury, death, mental trauma caused to any Contestant(s) and/or the Winner (s) in any manner whatsoever, in relation to the Show and/or prize.

49. The Company, Producers, Judges, the host/anchor, the advertising agencies, the subcontractors used by Company for the Show, and any person or entity connected with the production, administration or judging of the auditions, the Show or the Program (the “Relevant Parties”) shall be under no liability whatsoever to the Contestant(s), in respect of any loss, damage suffered by the Contestant(s) arising from or pursuant to the Show or for any and all loss, damage, cost, expense or injury to life or property sustained by the Contestant(s) at any stage of the Show and during production thereof whether or not caused by the administration (including scheduling) of the Show including any failure of transportation or inability for any reason to appear for the Audition/before the Judges; the Contestant’s participation in the Audition, or being selected or disqualified; (i) as a result of the decisions of the Judges or Company; (ii) as a result of any comment, remark, judgment, view, criticism, critique, opinion and/or observation made and/or passed by the Host/Anchor and/or Company; and/or (iii) any printing, typographical or technological errors in any materials associated with the Show notwithstanding the generality of the foregoing, the Relevant Parties expressly exclude liability for all direct, indirect and consequential loss or damage, including but not limited to loss or damage to property or for loss of profit, business, revenue, goodwill or anticipated savings pursuant to the Show. In no event will the measure of damages include, nor will the Relevant Parties be liable for, any amounts for indirect, incidental, consequential, or punitive damages of any party, including third parties; or for damages attributable to the Contestant(s); or circumstances beyond the Relevant Parties including the Producer’s reasonable control.

50. The Winner(s) and/or the Contestant(s) of the Show agrees that he/she shall hold harmless the Channel, Company, its employees, officers, subcontractors or any other person in connection with the prize won by him/her and/or in relation to the Show/Program including but not limited to the procedure in the Show and shall also not file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against sponsor and/or the Channel/Company/Producer to claim any damages or reliefs.

51. The Company / Producer will not be responsible for any loss / theft of belongings of the Contestant(s) on the shoot set / sets of the Show/Studio, before/during/after the shoot of the Episodes/Show, or at the time of the Audition.

52. The Company / Producer or any of its affiliates will not be liable for any loss of earnings, employment or otherwise caused to the Contestant(s) and arising as a result of his/her participation in the Audition or the Show Part, if selected.

53. Company / Producers and its sub-contractors cannot and shall not be held accountable/liable for any disruptions / stoppages / interruptions or cancellation of the Audition or Show on account of any factors beyond their control.

54. Company may upload Rules and Regulation in Malayalam. Please note the Rules and Regulations have been originally written in English and translated to Malayalam. In case of any conflict in the interpretation of the clauses between the Malayalam and English Rules and Regulation, the interpretation of the English Rules and Regulations shall prevail.
